Cyprus: The 60-Day Tax Residence Option for HNWIs
Cyprus has emerged as one of the leading destinations for UK high-net-worth individuals seeking tax-efficient relocation. The country's 60-day tax residence rule offers a flexible alternative to jurisdictions requiring longer physical presence, while its non-dom regime provides favourable treatment for investment income.
The 60-Day Rule Explained
Unlike most countries that require 183+ days of physical presence for tax residence, Cyprus offers a 60-day route.
To qualify, individuals must:
- Spend at least 60 days in Cyprus during the tax year
- Not spend more than 183 days in any other single country
- Not be tax resident in any other country
- Maintain a permanent home in Cyprus (owned or rented)
- Carry on business in Cyprus and/or be employed by a Cyprus company and/or hold office in a Cyprus tax-resident company.
This means someone can become Cyprus
tax resident while spending only two months per year on the island - provided they meet the other criteria and avoid establishing residence elsewhere.
Non-Dom Benefits
Cyprus operates a non-domiciled regime similar (in concept, if not detail) to the UK's former system.
Cyprus non-doms benefit from:
- Dividend exemption
- No tax on dividend income from any source, regardless of where the paying company is based. This is particularly valuable for business owners with investment portfolios or shareholdings in operating companies.
- Interest exemption
- No tax on interest income. Bank interest, bond coupons, and other interest-bearing investments are received gross.
- No defence contribution
- The Special Defence Contribution (SDC), which applies to dividends and interest for Cypriot domiciles, does not apply to non-doms.
What Is Taxable?
Cyprus non-dom residents remain subject to Cyprus income
tax on:
- Employment income from Cyprus sources
- Business profits from Cyprus activities
- Rental income from Cyprus property
- Cyprus-source income - certain others
Non-Cyprus source employment and business income may also be taxable if the 60-day residence is claimed (due to the employment/business nexus requirements), but structuring can often manage this.
The Lifestyle Proposition
Beyond tax, Cyprus offers:
- EU membership (important for access to Schengen, banking, and business)
- English widely spoken (legacy of British administration)
- Good flight connections to UK, Europe, and Middle East
- Lower cost of living than UAE alternatives
- Mediterranean climate and lifestyle
For those who want European residence with minimal physical presence requirements, Cyprus presents a compelling option.
Citizenship Pathway
While Cyprus's citizenship-by-investment programme was closed in 2020 following scandals, naturalisation remains possible after seven years of residence. EU citizenship, with its associated rights, remains a long-term possibility for those committed to the jurisdiction.
5 Planning Considerations
Key issues to address:
- UK departure: Properly severing UK tax residence is essential. The Statutory Residence Test sets specific requirements for leaving UK.
- Days counting: Keeping below 183 days in any other single country requires careful diary management.
- Banking: Cyprus banks may require additional documentation for UK nationals post-Brexit.
- Professional advice: The interaction of Cyprus, UK, and potentially other jurisdictions' rules requires specialist guidance.
- Substance: Meeting the business/employment nexus requires genuine Cyprus activity - paper arrangements are unlikely to withstand scrutiny.
